Thousands File Lawsuits Over Dangerous Surgical Staplers

Thousands of Americans across the country have suffered greatly due to dangerous surgical staplers. Unfortunately, thousands more will continue to suffer if we don’t act now.

Not until victims begin to file lawsuits will powerful manufacturers who hid the truth from both patients and regulators finally pay for their negligence.

Surgical Staplers Are Dangerous

Every year, millions of patients go through surgeries that require implantable or internal staples. These procedures, whether gynecologic, thoracic, or gastrointestinal, often lead to complications. And according to a report produced by the Food and Drug Administration (FDA), a seven-year review showed that manufacturers hid more than 56,000 of these complication reports from officials.

In many cases, patients suffered injuries and infections. Others died. Ethicon, one of the leading manufacturers of these staples, even had to issue a recall. However, since 2011, over 100,000 medical device complication reports were filed with officials tying surgical staplers to health problems. At least 400 patients died within the same period.

Prior to their surgeries, many of the patients who did experience issues did not know of the risks.

Doctors never alerted them of the potential dangers and neither did hospital staff. Despite this reality, dangerous surgical staples exposed them to tissue and organ damage, infections, cancer recurrence, internal bleeding, and other risks. They also made additional surgeries and death more likely.

Patients who suffered tremendously but never had a chance to decline being treated with the staplers shouldn’t be silenced.

Manufacturers are powerful and many have been negligent. If you’re a victim CALL NOW.

Most Common Surgical Stapler Complications

Doctors use surgical staplers as substitutes for stitches so tissues may be connected or wounds closed. In many cases, surgeons use staplers on the bowels, for instance, and because of the vulnerability of the tissue, patients suffer internal bleeding and infections.

In 2013, University of Pittsburgh doctors alerted patients that “Most minimally invasive surgeons have experienced laparoscopic linear stapler malfunction and 25% have had to significantly alter the planned operative procedure due to the malfunction.” However, it was only in 2019 that the FDA sent out warning letters to doctors about the risks, adding that the agency had learned of 41,000 reports of surgical stapler complications.

In that letter, regulators reported that 9,000 patients had suffered serious injuries while 388 had died.

Surgical staplers expose patients to risks. Below are some of the most common types of complications associated with the devices:

- Difficulty discharging staplers during procedure
- Misfiring of staplers
- Stapler malformation
- Off-sized staplers
- Staplers that are inadequate for a particular type of tissue
- Suture line opening
- Lack of training

The FDA classifies surgical staplers as Class I medical devices. This means they do not require pre-market testing. Furthermore, the agency never imposed a great deal of safety regulations on these types of devices.

Patients just never had a chance.

Who’s At Greater Risk of Suffering Surgical Stapler Malfunction?

Not all patients will suffer complications due to surgical staplers. However, those who will suffer will often have to undergo treatment for long periods of time, and will require expensive medical attention.

If your doctor is connecting tissues, cutting through organs, or if you are going through a gynecologic, thoracic, or gastrointestinal surgery, you might be more likely to suffer stapler malfunction.
